INTRODUCTION
This document aims to inform you about the general conditions applicable to bookings made through the website www.unicmallorca.com (hereinafter “the Website”).
On the Website, you will find information about room availability, rates, and services offered by Viatges Saluet, S.L.U., the company operating the accommodation ‘unic, turisme d'interior’. Bookings made through the Website are formalized directly between the user and Viatges Saluet, S.L.U., in its capacity as administrator of the online booking system.
Making a booking implies full and unconditional acceptance of the ‘Legal Notice’, the ‘Privacy Policy’, and these ‘General Booking Conditions’ in their latest version. Therefore, we advise you to read these conditions before making your reservation and each time you access our website, as the website reserves the right to change, modify, add to, or delete any part of these conditions at any time. LEGAL FRAMEWORK These general conditions are subject to the provisions of Law 7/1998 of April 13, on General Contract Terms, Royal Legislative Decree 1/2007 of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, Law 34/2002 of July 11, on Information Society Services and Electronic Commerce, as well as all applicable tourism regulations and, subsidiarily, the Civil Code and the Code of Commerce.
TERMS AND CONDITIONS
Reservations made through the Website are subject to the following terms and conditions:
1. STATEMENTS
THE USER STATEMENTS:
That they are of legal age and have full capacity to make the reservation, stating that they understand and comprehend all the conditions found on the Website.
That the data provided when making the reservation is true, complete, and accurate.
That they confirm the requested reservation and, in particular, the indicated dates, the number of rooms, the number of people, the accommodation, and the meal plan chosen.
That the User or the people who will enjoy the reservation are the holders of the credit card used for payment.
2. WEBSITE ACCESS
Access to this website is the user's responsibility.
3. PURCHASING PRODUCTS AND SERVICES THROUGH THE WEBSITE
3.1.The booking includes the services detailed according to the booking conditions stipulated on the page from which the booking is requested or finalized.
3.2. All stays may only be enjoyed by the reservation holder and their companions. Viatges Saluet, S.L. reserves the right to refuse changes to reservation holders, both individual and group, and to cancel any reservations in which a change of holder has been made without the prior and express approval of Viatges Saluet, S.L.
3.3. Accommodation providers, each within the scope of their respective obligations, will be responsible to the user for compliance with the obligations arising from current regulations and the terms and conditions of sale of each of the products and services contracted. The user accepts that Viatges Saluet, S.L. assumes no obligation or responsibility whatsoever with respect to services it does not directly provide, and in particular with respect to the lack of truthfulness, incompleteness, lack of updating, and/or inaccuracy of data or information regarding offers, products or services, prices, characteristics, and any other relevant data and information about the products and services offered through the Website by accommodation providers. 3.4. These ‘General Booking Conditions’ must be accepted by the User before formalizing the booking. In this regard, from the moment the User makes their request, their booking is subject to these conditions and, consequently, to the cancellation and no-show policy set out below. Furthermore, in order to process the booking, the User must accept the ‘Privacy Policy’ of Viatges Saluet, S.L. accessible on the website www.unicmallorca.com.
3.5.The contract may be validly formalized in any of the languages available on the website.
4. THE ONLINE BOOKING PROCESS CONSISTS OF 4 STEPS
4.1.Availability: Search for dates, number of people, and rooms.
4.2.Choose meal plan, room type, and rate.
4.3.Booking summary, collection of customer data, and, where applicable, payment via virtual POS terminal.
4.4.Booking confirmation.
Once the booking is made, the emails and logs generated by the transaction will be archived. The customer will receive their booking details by email, along with a unique identifier (locator), allowing them to access the details at any time.
Viatges Saluet, S.L.U. will confirm the booking request made by the User by email within a maximum of 24 hours of receiving the request. If this email is not received, the booking request will be considered invalid.
For the purposes described above, the User expressly consents to Viatges Saluet, S.L.U. A pre-authorization of the payment card will be carried out to verify the availability of funds and the card's originating information. 5. PRICE AND PAYMENT 5.1. The conditions, price, and payment for the planned stay are those expressly stated in the rate conditions included on the page where you make the reservation. 5.2. Promotions and offers will only be valid while they remain accessible to the recipients of the service. 5.3. The prices shown on the website are retail prices, including VAT. The transaction will be processed in EUROS, regardless of the customer's country of origin.
PRICE INCLUDES:
Price per night based on the selected room type and meal plan.
PRICE DOES NOT INCLUDE:
Any unspecified services, as well as extras such as taxes, transfers, tips, telephone calls, laundry services, minibar, parking, etc.
5.4.Viatges Saluet, S.L.U. reserves the right to modify reservations that may be affected by a system error, third-party issues, or other unforeseen circumstances. In such a situation, the User will be informed in writing of the current price and/or possible alternatives. If the new conditions are not accepted, the User will have the right to cancel the reservation free of charge. If no response is received from the User within 48 hours of the reservation modification, Viatges Saluet, S.L.U. will cancel the reservation at no cost to the User. 5.5. Viatges Saluet, S.L.U. reserves the right to unilaterally cancel the reservation if it detects any issue with the credit card provided for payment; lack of compliance; discrepancy between the cardholder and the User and/or the guests; or breach of any of the conditions or declarations contained herein. 6. CANCELLATIONS/MODIFICATIONS OF RESERVATIONS AND NO-SHOWS 6.1. Subject to the applicable conditions according to the rate selected by the customer. 6.2. All applicable charges will be made to the bank card you provided during your booking.
6.3.The User expressly consents to these charges to cover any applicable penalties for cancellations or no-shows.
6.4.Depending on the selected rate, payment will be made upon confirmation of the booking or at the hotel. In the latter case, in the event of cancellations or no-shows, the booking will be cancelled and the charge specified in the rate conditions will be applied.
7. CHANGES TO STAY
If the client wishes to extend or shorten their stay at the establishment or change the number or type of rooms, they must always notify Viatges Saluet, S.L.U. through the customer service telephone line, where they will manage the requested services, according to the conditions of your rate. If the change of dates implies a change of rate, the rate corresponding to the dates of the stay will always be applied. 8. LIMITATION OF LIABILITY FOR WEBSITE OPERATION Viatges Saluet, S.L.U. is not liable for any damages arising from interference, interruptions, computer viruses, telephone malfunctions or disconnections caused by reasons beyond the control of the aforementioned company; for delays or blockages in the use of this electronic system caused by deficiencies or overloads in its data processing center, telephone lines, the Internet system or other electrical systems; nor for any other alteration that may occur in the users' Software or Hardware.
Similarly, Viatges Saluet, S.L.U. will not be liable for damages caused by third parties through unlawful interference beyond our control. Nor will it be liable for damages caused by the use or misuse of the website's content, or for the consequences that may arise from errors, defects, or omissions in the content that may appear on this page provided by third parties, the chosen hotel being considered a third party for these purposes. The information on this website is updated periodically. The user should always verify the information provided before acting upon it.
You agree and warrant to Viatges Saluet, S.L.U. that you will not use its website or register on it for unlawful or prohibited purposes, or to prevent other users from accessing the website, for resale purposes, or for any other unauthorized purposes in accordance with these terms and conditions.
7. NOTIFICATIONS
All notifications, requests, petitions, and other communications that must be made by the parties in relation to these general terms and conditions must be made via email or through the contact form available on the Website.
8. NULLITY OF CLAUSES
If one or more of the clauses included in these general terms and conditions is declared wholly or partially null or ineffective, this will only affect that provision or the part that has been so declared, with the general terms and conditions remaining in full force and effect in all other respects, and such provision, or the affected part thereof, will be deemed not to have been included.
9. ACCEPTANCE
The request and formalization of the reservation necessarily imply that each and every one of these general terms and conditions, considered as an integral part of the reservation and supplemented by the fare conditions and the specific applicable legislation, are expressly accepted by the User.
10. APPLICABLE LAW AND JURISDICTION
This contract shall be governed by Spanish law, and for any dispute that may arise with respect to its validity, execution, performance, or termination, in whole or in part, the parties, expressly waiving any other jurisdiction that may apply, expressly submit to the jurisdiction of the Courts of Palma de Mallorca (Spain).
